The following terms and conditions apply to all services provided by the privately run Institut für psychisch-dynamisches Rollenspiel und Dominanz, Munich - Comtesse Desiree, represented by C. Ihler. They therefore also apply to all future business relationships, even if they are not expressly agreed again. By booking a service and thus receiving confirmation by SMS, the contractual terms and conditions are considered binding and accepted. The General Terms and Conditions are an integral part of the Institute for Psychic-Dynamic Role Play and Dominance - Comtesse Desiree - in Munich. Deviating general terms and conditions of national and international contractual partners are not part of the contract.
§ 2 Conclusion of the contract and service agreements
Verbal statements or promises are binding and are deemed to be a legally effective conclusion of contract. Agreed dates are firm bookings and must be kept! All personal details, preferences and other information must be provided truthfully. All data and information will be treated as strictly confidential. The services are provided in the form of sessions. Each session takes place under the condition that the client or candidate is treated psychologically and physically. This means that the temporary fulfillment or satisfaction of existing inclinations and fantasies is sought with the given means. The focus is on helping the client or candidate in the long term and on a regular basis to support them in living out their respective predispositions in the field of SM.

Should the customer or client wish to withdraw from the booked appointment, or should he not make use of the agreed services without withdrawing, the Institute for Psychic-Dynamic Role Play and Dominance, Munich - Comtesse Desiree - is entitled to demand appropriate compensation for the arrangements and plans made.
This also applies if the client is not at fault. The Institut für psychisch-dynamisches Rollenspiel und Dominanz, München - Comtesse Desiree - is entitled to demand a lump sum for damages. The date of receipt of the cancellation is decisive. Cancellations are only accepted on working days between 09:00 and 20:00. If the agreed service is not utilized without cancellation, the client must pay the agreed price without deductions. The customer is obliged to inform Comtesse Desiree in advance of any taboos as well as physical and mental impairments with regard to which special caution is required during the game (e.g. pacemakers, joint injuries, allergies, trauma, etc.). In particular, the customer undertakes to provide comprehensive and truthful answers to all questions relating to his/her person, health status and previous experiences in similar sessions.

Due to the recent increase in the number of so-called “fake appointments”, à-conto payments must be made in advance for overnight, long-term and midnight sessions, as well as for appointments on Sundays and public holidays. Payment must be made at least 1 working day in advance for overnight appointments and at least 2 working days in advance for long-term appointments. Otherwise the entitlement to services shall lapse; the claims and cancellation fees shall remain in accordance with the agreements.
Unless otherwise agreed, the prices of the offer on which the service is based always apply. In the case of text messages and/or e-mails containing more than 50 characters and telephone calls that are not directly used to find an appointment but are misused to obtain a service and/or lead to commercial damage,
the sender or client must expect legal and financial consequences. All contacts that are not used to make appointments but merely for verbal, personal or sexual gratification will be prosecuted and reported.
The costs of investigations to establish identity will be borne by the perpetrator.
The customer will be informed if he/she attempts to conceal his/her identity or has made untruthful statements about his/her identity or intentions. The Institut für psychisch-dynamisches Rollenspiel und Dominanz,
München - Comtesse Desiree - reserves the right to file a criminal complaint with the Munich public prosecutor's office for intentional fraud and fraudulent misrepresentation to obtain professional services.

If the party responsible and the contractual partner are not identical, both shall be liable as joint and several debtors. Liability shall exist even if the client is not at fault.
